If the suit survives, it would put the ski industry's practice of exchanging business information under judicial scrutiny, testing how far cooperation between resort operators can go before it becomes unlawful coordination on price.

Resorts push back against collusion claims

Vail Resorts, Alterra Mountain and two other large American ski resort operators are contesting allegations that they worked together to drive up the cost of lift tickets and season passes. The companies have asked a federal court in Colorado to dismiss the antitrust lawsuit, which they say is unfounded.[S1][S2]

The operators deny that they colluded on pricing. Their request to have the case thrown out sets up an early test of whether the plaintiffs have alleged enough to keep the litigation alive in federal court in Colorado.[S1]
