Allegations of Physical Abuse
Olivier Martinez, who was formerly married to Halle Berry, has sought a temporary restraining order against her, alleging she physically harmed their son Maceo. In court paperwork obtained by Page Six, Martinez asserts that on Sept. 26, Berry leapt onto the 12-year-old boy, wrapped her hands around his throat and strangled him. Berry's fiancé, Van Hunt, was reportedly there when it happened. Martinez says the dispute started when Berry called Maceo stupid and an idiot for using his virtual reality goggles in a game.[S1]
Martinez goes on to claim the confrontation worsened, with Berry seizing Maceo by the throat and strangling him while yelling about who was dominant. He says a frightened Maceo phoned him to come get him afterward and told him he was traumatized and did not want to go back to his mother's home. Martinez also contends that Berry has mistreated their son repeatedly and that this was not a one-time event, saying that over the past year and a half she had thrown Maceo to the ground and made him submit.[S1]

The filing also contains Martinez's claim that Berry inflicted mental and emotional harm on Maceo through racially charged remarks. He alleges that in 2023 the Oscar winner told their son his father was a white b—h attempting to rob a black woman, tied to their child support dispute. Martinez further states in the documents that he holds serious worries about Berry's mental state and her drinking, which he thinks played a role in the alleged mistreatment. He is asking for sole custody of Maceo along with restraining orders for himself and his son.[S1]
Page Six contacted representatives for both Berry and Martinez seeking a response. Berry and Martinez, each 60, were married two years and separated in October 2015, with their acrimonious divorce taking eight years to complete. In September 2024, Berry said in a court filing that she had spent more than $200,000 attempting to co-parent Maceo during their heated custody dispute. Besides Maceo, Berry also has a daughter, Nahla, 18, with her ex Gabriel Aubry.[S1]
